Debt Relief Cost Guide

Forgiven debt is income to the IRS - unless you were insolvent

The settlement letter is not the end of the math: forgiven debt of $600 or more generates a 1099-C, and whether Ontario filers owe tax on it turns on one IRS worksheet most people never hear about.

Debt settlement companies serving Ontario charge 15-25% of enrolled debt - on a $20,000 balance that is $3,000-$5,000 in fees, legally collectible only after each account actually settles.

Median household income in Ontario's county (San Bernardino County) is $87,665 per Census SAIPE 2024 - a $20,000 card balance is roughly 23% of a full year's median income there, which is why timeline matters as much as fee.

In California, the statute of limitations on credit card debt is 4 years (Cal. Civ. Proc. Code § 337 (written contracts and book accounts, 4 yrs); § 339 (oral, 2 yrs)) - after that a collector can still ask, but can no longer win a lawsuit on the old debt.

The brochure shows the debt shrinking; the full math includes the fee and possibly the IRS. Running all three numbers before enrolling is the difference between a real saving and an expensive surprise.

A settled debt can come with a tax form: forgiveness of $600 or more generates a 1099-C, and the IRS treats canceled debt as income unless an exception applies. The good news is the main exception fits exactly the people who settle.

Two honest starting points: a free session with a nonprofit credit counselor, and a no-obligation quote from a settlement provider whose fees are only due after debts settle. Getting both costs nothing and disciplines everything.

The insolvency exclusion, plainly

If your total debts exceeded your total assets immediately before the settlement, IRS Form 982 can exclude some or all of the forgiven amount from income. The people most likely to settle are exactly the people most likely to qualify - run the worksheet before assuming a tax bomb.

What this means in Ontario

What costs Ontario debtors the most is not the 15-25% fee - it is enrolling debts that never settle: the fee-free failure that still wrecked the credit report. Completion odds belong in every quote.

Common questions

Can I settle debts myself without a company?

Yes - creditors negotiate with individuals every day. Wait until the account is genuinely delinquent, save a lump sum, get every offer in writing before paying a cent, and never give a collector direct access to your bank account. Realistic DIY targets mirror the industry's outcomes; the difference is you keep the 15-25% fee.

Is bankruptcy worse than debt settlement?

Not automatically - it is the comparison the settlement industry least wants you to run. Chapter 7 costs $338 in filing fees plus typically $1,000-$3,000 in attorney fees, resolves in months, and stops lawsuits cold; settlement takes 24-48 months and can cost more. Bankruptcy marks credit up to 10 years, but a consult is cheap insurance before signing anything.

Was medical debt removed from credit reports?

Not the way the headlines said. The federal rule that would have removed it was struck down in court in July 2025 and never took effect. What remains is voluntary bureau policy: paid medical collections are removed, unpaid ones under $500 are not reported, and there is a one-year wait before reporting. Unpaid medical debt above $500 can still show up.

Will I owe taxes on forgiven debt?

Often. Forgiveness of $600 or more generates a 1099-C, and the IRS treats canceled debt as taxable income unless an exception applies. The big one is insolvency: if your debts exceeded your assets right before the settlement, IRS Form 982 can exclude some or all of it. Run that worksheet before assuming either answer.

How much of my paycheck can be garnished for card debt?

Federal law caps most consumer garnishment at 25% of disposable earnings, and many states protect more - a few effectively bar wage garnishment for consumer debt entirely. The rule for your state is on this page with sources. That number sets your real leverage in any negotiation.
